Since a number of plots were sold by the landowner in the Coombes woodland in 2018 (see many previous Alerts), the plot bought by Candice and Dean Jules (“White Heart Grove”) has been the subject of refused planning applications, enforcement orders, injunctions and at least one appeal to the Planning Inspectorate, which was also refused.

In 2019 the Jules were ordered to remove a building which they had erected, including foundations and associated “residential paraphernalia” from their land.  After much delay and an appearance in the High Court, the Jules finally complied with the order.  However, rather than remove the materials completely from The Coombes, they moved them to an adjacent plot.  This plot is an unusual shape and was originally marketed as potentially providing an access track/road to other plots.  However, as far as we are aware this “road” plot was never sold.  Subsequently the company which owned the “road” plot went into liquidation.  This plot now may be subject to “bona vancantia” whereby it would pass to the Crown.

The Jules were served with the latest enforcement order by WBC to remove their materials from this “road” plot but have now appealed to the Planning Inspectorate.  Details of their rationale for the appeal can be found in the documentation on the WBC website at

You will see that they are claiming these materials are just “parked” on the access track prior to permanent removal.  However, WBC has seen no intention to properly remove the material from the Coombes, hence the latest enforcement order.

Plot B “the water tower plot”

Another long running saga concerns Plot B.  Originally owned by Dean Thomson, he lost an appeal in 2020 against enforcement orders concerning the “water tower”, fencing and a culvert.  He subsequently sold the plot but the new owner does not seem to have done any searches to identify the existing enforcement orders, which carry forward.  Also, Dean Thomson is still shown as the owner on Land Registry and the new owner has not properly registered ownership.

WBC have sought legal advice to try to bring this saga to an end and ensure the new owner complies with the enforcement orders.
