This is an update on our previous alert (4 August) on WBC’s progress in taking enforcement actions against 2 of the plot owners in The Coombes.

Jules’ plot.  This was heard in the High Court on 8 October in relation to breaches of the injunction on the Jules’ land. The Respondents (Jules) admitted the breach and were found guilty of contempt of court. To quote from the judgement:

“AND UPON the Respondents offering, and the Court accepting, an undertaking that by 4pm on 5 November 2021 they shall remove, or cause to be removed, from the Site:

  1. (a)  the “shed” structure;
  2. (b)  the concrete foundation underneath the same;
  3. (c)  the toilet and washstand;
  4. (d)  the timber walkway;
  5. (e)  all building materials; and
  6. (f)  all resultant debris and materials.”

There will be a further hearing for the judge to consider sanctions on 12 November.

Plot B.  As a reminder from our 4 August update, this was previously owned by Dean Thomson but was sold in late 2020. However, the Enforcement Orders transfer to the new owner.  After some difficulty identifying the new owner, WBC have made contact with them.  Apparently, they purchased the land without carrying out searches but was aware some remedial works were required. WBC are now chasing for compliance with the 2 outstanding enforcement notices and will continue to work on this.

This is still an outstanding issue, but WBC will continue to pursue it.
